Amana fridge not cold and freezer is freezing

Amana fridge, 5yrs old is not cool. Temp is 12degrees, food spoiling. Freezer is fine, if anything freezing ice cream too hard. Had a technician come round to have a look who claimed that it is a design fault and charging me $160 for that! Don't think that it is a design fault otherwise the fridge wouldn't be built, hence would appreciate an honest and professional service.
