BREACHES IDENTIFIED (refer to attached site plan for location of breach item numbers below):
1. Existing metal gate does not self-latch. The gate is deemed a high-risk hazard for young children.
Remedy: Either adjust the latching device body or striker body so that the magnetic latch is separated from the striker body with a 3mm gap.
2. Stepped fence near southern side boundary masonry retaining wall is not shielded
appropriately. A young child could pass around the panel and enter the pool area.
Remedy: Either screw fix a suitable shield (maximum opening aperture of 13mm) 900mm wide and 1200mm high flush on top of the masonry block wall at 90 degrees to the existing upper fence panel or screw fix a suitable shield (maximum opening aperture of 13mm) 900mm wide and 1200mm high on top of the existing metal fence using the existing fixing points and ensure the outer edge of the panel is adequately braced to prevent flexing and possible breakage. The shield panel must be rigid.
3. Several timber palings are loose on the timber paling fence. The loose boards can become detached providing a gap in the fence allowing access for a young child to enter the pool area.
Remedy: Either screw-fix or nail all loose palings back onto the horizontal rails of the fence.
4. A gap exceeding 100mm (170mm actual) is between the metal fence panel and timber paling fence on the northern side boundary. The gap is deemed a high-risk hazard that may allow a young child to pass through the barrier.
Remedy: Fix a solid panel or similar obstruction, with a minimum height of 1200mm, in the gap between the metal fence panel and timber paling fence.
5. A gap exceeding 100mm (155mm actual) is at the base of the metal fence with loose
decorative stones capable of being pushed aside. The potential gap is deemed a high-risk hazard for a young child to crawl under the fence.
Remedy: Either screw-fix a solid panel to the base of the fence panel, for the entire length of the fence panel, to ensure the gap between the base of the fence panel and compacted ground (not top of decorative stones) is no greater than 100mm or lay a strip of pavers or bricks in concrete under the base of the fence panel, for the entire length of the panel, to ensure the gap between the base of the fence panel and pavers/bricks is no greater than 100mm. Note a combination of the two options may be used to be deemed compliant.
6. There was no resuscitation sign on display.
The sign must be securely mounted in a prominent position close to the pool area (preferably at eye level when kneeling on the pool surround). The sign is to be of durable material capable of withstanding the weather and be splash-proof. I have a sign.
